Terms of service
These Terms of Service ("Agreement") govern the use of the services provided by Mint Condition Services LLC. By accessing or using our services, you (Client), agree to comply with and be bound by this Agreement.
1. Services Provided
Mint Condition Services LLC offers a variety of mobile services, including but not limited to the following:
Urine Drug Testing
Oral Drug Testing
Breath & Alcohol Testing
Mobile Notary Public Services
Ink Fingerprinting Services
2. Appointment Scheduling
To use our services, you must schedule an appointment via our website, phone, or other authorized booking methods. You are responsible for providing accurate and complete information during the booking process, including your contact details and testing requirements.
3. Client Responsibilities
Identification: Clients must provide valid government-issued identification at the time of the service to verify identity.
Compliance: Clients agree to follow all instructions provided by our team during testing or notary services, including abstaining from substances or actions that may interfere with testing.
Payment: Clients agree to pay for services rendered according to the pricing structure set forth on our website or provided at the time of booking. All payments are due at the time of service, unless otherwise agreed.
4. Privacy and Confidentiality
We understand the sensitive nature of drug testing, fingerprinting, and notary services. All results, documents, and personal information collected will be handled with the highest level of confidentiality, in compliance with all relevant laws, including but not limited to HIPAA (Health Insurance Portability and Accountability Act) and other privacy laws as applicable.
Urine, Oral, and Breath & Alcohol Testing: We will report test results only to the designated recipient (individual, employer, or other authorized party). We will not share results with any third party without your consent unless required by law.
Notary Public and Fingerprinting: Documents notarized and fingerprinting services performed will remain confidential, except where required by law or with your express consent.
5. Test Results and Accuracy
While we strive to ensure the accuracy of all tests and services, we do not guarantee results. All drug tests, breath and alcohol tests, and fingerprinting services are performed following industry-standard protocols. However, errors may occur, and results are subject to the interpretation of laboratory analysis (if applicable).
Urine and Oral Drug Testing: We are not responsible for false negatives or false positives resulting from testing. You may request a second test or confirmatory testing through a certified laboratory.
Breath & Alcohol Testing: Breath and Alcohol test results are accurate based on the equipment used and the individual’s compliance with the instructions. If you believe the result is inaccurate, you may request a second test (an additional fee may apply).
6. Mobile Notary Services
Notarization Process: Our notary public services are provided in accordance with state and local laws. Notary services are available for documents requiring a witness or acknowledgment.
Client Identification: All individuals requiring notary services must present valid identification before the notarization can proceed. Our notaries will not notarize any document if the signer is not properly identified.
7. Ink Fingerprinting Services
Fingerprinting Process: Our ink fingerprinting services are provided for background checks, employment purposes, or other legal requirements. We will take fingerprints on official fingerprint cards as required.
Client Responsibilities: Clients are responsible for ensuring they meet the specific requirements for fingerprinting (such as having appropriate documentation) before the appointment.
8. Cancellations and Refunds
Cancellations: You may cancel your appointment up to 24 hours in advance without incurring a cancellation fee. Cancellations made within 24 hours of the scheduled appointment may incur a cancellation fee as outlined during booking.
Refunds: Refunds are not issued for services that have been completed. If an error occurs in the administration of a service, we will work with you to resolve the issue, which may include providing an additional service free of charge.
9. Limitation of Liability
To the fullest extent permitted by law, Mint Condition Services LLC., shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. Our liability for any direct damage(s) will be limited to the amount paid by you for the specific service that caused the damage.
10. Indemnification
You agree to indemnify, defend, and hold harmless Mint Condition Services LLC., its officers, employees, agents, and affiliates from any and all claims, losses, damages, liabilities, and expenses (including attorney’s fees) arising out of or related to your use of our services, including any breach of these Terms of Service.
11. Modifications to Terms of Service
We reserve the right to modify these Terms of Service at any time. Any changes will be posted on our website, and such modifications will be effective immediately upon posting. It is your responsibility to review these terms periodically for updates.
12. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any dispute arising from this Agreement shall be resolved in the state or federal courts located within Arizona.
13. Right to Refuse Services
We reserve the right to refuse services under the following circumstances:
Non-Compliance: If a client does not comply with the instructions provided by our staff, or engages in behavior that is disruptive, unsafe, or inappropriate during the service.
Inadequate Identification: If the client is unable or unwilling to provide valid identification when required for any service, including but not limited to drug testing, notary services, or fingerprinting.
Health and Safety Concerns: If there are any concerns regarding the client’s health, such as suspected intoxication, illness, or medical conditions that may interfere with testing, we may refuse service to ensure the safety of both the client and our staff.
Fraud or Misrepresentation: If we have reason to believe that any information provided during the booking or testing process is fraudulent or misrepresented.
If we refuse service, no fees will be charged for the refused services, and any payments made will be refunded. However, if the refusal is due to the client’s actions, we reserve the right to charge a cancellation or administrative fee.
14. Certification and Qualifications
Mint Condition Services LLC is certified and adheres to the highest industry standards in all services provided. Our team is fully trained and certified in the administration of drug and alcohol tests, mobile notary services, and ink fingerprinting. This includes successful completion of the DOT Urine Collection training according to DOT regulation 49 CFR part 40, BAT(Breath and Alcohol Testing) certification, HIPPA certification, CPR certification, and National Notary Association (NNA).
